4-Year-Old Boy Ejected When Pickup Truck Crashes

The boy, whose name was withheld because of his age, suffered a cut to the left side of his head and was flown directly to Community Regional Medical Center in Fresno.  Officials said the boy may have suffered internal injuries as well.

“He was awake and alert [at the scene],” said California Highway Patrol Officer Federico Martinez.  The CHP said the truck’s driver, Maria Hernandez, 35, of Earlimart, lost control of the vehicle, which subsequently went off the road and overturned.

Our firm’s truck accident attorneys know how dangerous an accident with a child can be, especially in a truck.  Children’s injuries can be life altering, usually requiring medical treatment for the rest of the person’s life, if it does not escalate into a wrongful death.

Hernandez, the boy’s mother, along with five other occupants, ages 14 to 6 months, suffered minor injuries and were taken to Tulare District Hospital for medical treatment.  She was treated and released, a hospital spokeswoman said.  Hospital officials could not release further information about the others because they are minors.

At this point, police are not sure of the cause of the accident, but they suspect that Hernandez’ car accident may have been due to distracted driving, taking her off course and thus causing her to overcorrect, which resulted in the overturn car accident.  The CHP said the boy was ejected because he was not wearing a seat belt.

Our truck accident attorneys have heard of cases where parents being distracted by young children end up taking their attention off the road and getting into auto accidents.  In this case, the severity of the auto accident was increased for the 4-year-old boy, because he did not put on his seat belt.

The CHP said Hernandez will likely receive a citation for having an un-seatbelted passenger.
