A bad decision made by 40-year-old Joseph Venegas led to the drunk driving car accident in San Diego that caused the wrongful death of 21-year-old Elaina Luquis Ortiz of Lemon Grove.

Ortiz was waiting for a tow truck on the northbound side of Interstate 805 by the Home Avenue exit after having car trouble. She called a friend who met up with her and parked a Mazda behind Ortiz’s disabled car. At about 3 a.m. as the group was waiting for the tow truck, a 2006 Chevy sport-utility vehicle driven by Venegas ran into the Mazda. Ortiz died at the scene, and her two friends were taken to a hospital for major injuries.
Venegas was arrested on suspicion of felony drunk driving, and if it’s proven he was drinking and driving, his negligence cost the life of Ortiz as well as her child because Ortiz was six months pregnant. If he is convicted, Venegas faces up to 16 years in prison.
