NY Increases Penalties For DUI With Child In Car

It is a shame that it takes the death of a child to make the legal system create a law that will hopefully lower the number of personal injuries and wrongful deaths that occur every year due to drunk driving.  But sometimes, that’s the only way things get done.

The state of New York has recently passed the Leandra Rosado Law which makes it a felony to be driving under the influence of alcohol or drugs when a child is a passenger.  The law is named for Leandra Rosado, an 11-year-old girl who was killed by a parent of her friend who drove drunk and crashed her car in Manhattan.

He is not the only one who is trying to overcome the wrongful death of a child caused by drunk driving.  In July, 2009, a Long Island motorist drove the wrong way on the Taconic Parkway in Westchester County, causing the deaths of her two-year-old daughter, three young nieces, as well as three others and herself.  She had marijuana in her system and her blood alcohol content (BAL) was 0.19 percent – more than twice the legal limit of 0.08 in the state of New York.

After gaining support from governor David Patterson, the law was passed.  Now drivers convicted of driving while intoxicated with passengers that are 15-years-old or younger may have to spend four years in prison for their crime – regardless of whether or not their actions result in a car wreck.  Our car accident attorneys in San Diego are happy that stricter laws are being put in place around the country because it is one more way to help prevent drunk-driving accidents from happening in the future.
