Wrongful Death Lawsuit Filed For Hit-And-Run Of Teen

A lawsuit has been filed by the family of Robert Ogle, a 16-year-old junior at Brooklyn Technical High School, who suffered a fatal accident in a hit-and-run pedestrian accident as he walked home from a party on February 1, 2009.

As pedestrian accident attorneys, we know that pedestrian accidents are often the worst types of car accidents to happen.  Many times they can lead to personal injury or even wrongful death and the amount of damage only increases when alcohol is involved.  When a driver leaves the scene of the accident, then the auto accident is termed a hit-and-run.

The parents of Robert Ogle filed a wrongful death lawsuit against four individuals involved in their son’s death.  Robert was attending a party hosted by adults who served him and his underage friend alcohol as minors.

“Each person in their own way contributed to this train wreck… If everyone had exercised better judgment, my son would be alive today,” said Brendan Ogle, as he filed the wrongful death lawsuit in a Queens Supreme Court against the party hosts for involvement in his son’s fatal incident.

One of the adults involved in Robert Ogle’s death, Kenneth Guyear was charged with a DUI and manslaughter.  Guyear is also charged with negligence in the wrongful death lawsuit.

According to police reports, at 1:30 a.m. on the night of the pedestrian car accident, a drunk Guyear jumped into a Kia automobile while his friends entered a convenience store and sped off in his car.  A few blocks later, Guyear ran into the a group of people causing the wrongful death pedestrian accident.

Robert was being walked home by his friend because the teenager drank too much at the party thrown for his birthday.

Our pedestrian accident attorneys feel saddened that another accident had to occur when we know several ways to prevent drunk-driving in our communities.  Unfortunately, a young person had to lose their life for the message to be driven home.
