Bioengineered proteins, which mimic natural substances that promote bone growth, were first approved in 2002 by the Food and Drug Administration (FDA) but initially only for use in spinal fusions to alleviate lower, or lumbar, back pain.
Last year, the FDA issued an alert after receiving reports of life-threatening personal injury complications following cervical fusion procedures involving the proteins, including breathing difficulty and swelling of the neck. If not properly treated any of these complications could lead to a wrongful death.
The use of medical products that have not been approved by the FDA can lead to personal injury or wrongful death in patients because the product has not been cleared for its safety.
If these substances are not federally approved why then do doctors continue to use them for medical treatments when they are known to cause more personal injury to patients?
