Two UnitedHealth Group executives appeared before a Senate panel on March 31, 2009, about the reports that the group short-changed customers’ medical bills for out-of-network care.

The specific case being made was whether databases run by a UnitedHealth unit allowed insurers to cheat consumers on payment of medical bills for using doctors out of the insurers’ own networks.
Representing UnitedHealth were chief executive Stephen J. Hemsley and Andy M. Slavitt, the head of their database business known as Ingenix. The database came under inspection by New York’s Attorney General, Andrew M. Cuomo who found Ingenix was responsible for underpayments to New York customers of as much as 28 percent.
Cuomo reached a settlement with UnitedHealth in which the company agreed to spin off its databases into an independent entity. UnitedHealth also reached a $350 million agreement to settle private litigation for its payment of out-of-network claims, but that settlement has not been approved by the court.
