Health insurance companies are denying treatment for some autistic children, but a consumer advocacy group has stepped in to try to stop it. If that fails, how will these families find help paying back these high medical bills for their children’s necessary medical treatment?
Our firm’s San Diego personal injury lawyers often help our clients pay their medical bills. On many occasions, our clients are injured in automobile accidents, and we help them by settling a personal injury claim with their auto accident insurance company.
Families with children suffering from autism, meanwhile, are receiving help for their medical bills by way of a consumer advocate group, Consumer Watchdog. Consumer Watchdog filed a lawsuit, on the families’ behalf, to order the Department of Managed Health Care to require insurers to provide autistic members with the services recommended by their physician.
Currently, one in 150 children are born with autism. A child with autism has difficulty communicating and socializing with others and often exhibit repetitive, injury-causing behavior. Treatment for autism can be very expensive, sometimes as much as $70,000 a year in medical bills, so health care providers have been attempting to avoid footing the medical bill for it.
In 1999, California lawmakers adopted the Mental Health Parity Act, requiring insurers to cover medical care for mental and behavioral disabilities with the same coverage as physical illnesses and personal injuries. So when physicians tell the parents of an autistic child that their child needs expensive behavior-modification therapy, how do they say no to the health of their child, even at the high cost of these medical bills?
Without help from the courts, many autistic children will suffer and many families could face medical bill-related bankruptcies.
