Nevada Law Allows Higher Medical Malpractice Settlements

Our firm’s San Diego personal injury lawyers always work to make sure clients seeking the best result in a medical malpractice claimor medical malpractice lawsuit get what they need to help pay for future medical bills, wrongful death and pain and suffering.

A new law passed in Nevada allows greater settlements to medical malpractice lawsuits.

The Nevada Assembly responded to a 2008 hepatitis C outbreak at two now-closed outpatient clinics – the largest patient notification in U.S. history (50,000) – with AB495, a new law that removes the cap for settlements in medical malpractice lawsuits.

Critics of the new law say the new law could require doctors to buy more costly insurance, and lead to more doctors leaving the state.

Our San Diego personal injury lawyers, however, we believe that clients should receive the maximum settlement in a medical malpractice lawsuit regardless of what could happen to other doctors in the state.  Doctors who make mistakes should be held accountable in medical malpractice lawsuits when their care leads to further personal injury.
