Depression disorders affect about 9.5 percent of Americans. Treatments for the disorders were developed in the 1950s and 1960s, and those treatments have evolved since then. A dangerous new way to treat depression could cause personal injury and lead to pharmaceutical medical malpractice claims.
The first wave of depression treatment was Thorazine and Haldol. There have been advances in treatment since then leading to the development of drugs like Abilify. Abilify was granted the legal right to market to a new population of patients beyond patients with schizophrenia or bipolar disorder.
The Food and Drug Administration advisory panel suggested that the agency should grand a second anti-psychotic drug, Seroquel XR, the same permission, but Dr. Steven Nissen, chairman of the Cleveland Clinic’s cardiovascular medicine department, has concerns — as well as our firm’s San Diego personal injury lawyers — about the treatment whose side effects could cause further personal injury and result in pharmaceutical malpractice claims.
“This is very worrisome; frankly I have serious concerns about these drugs.”
The FDA’s panel said the drug was safe if used with other drugs, but Seroquel and Abilify should not be used when used by themselves. Weight gain emerged as a side effect, but there are other conditions that are more serious personal injuries. For example, Alzheimer’s disease patients who were given the drug to control aggression were twice as likely to die of any cause as those not given the drug. Other studies revealed the likelihood of stroke or fatal heart attack.
The evolution of treatments continues to be important in our society, but as personal injury lawyers in San Diego, we believe proper testing before any new drugs are released to the public and prescription of new medication is vital. Every possible precaution must be taken before a new product is given to the population for the condition they suffer from. Proper testing and development means fewer mistakes and fewer personal injury from pharmaceutical medical malpractice claims.
