A new $350 million settlement can correct mistakes that arose when medical bills of Americans rose because of the overcharging of prescription drugs.
The prices of many brand-name drugs will be cut 4% and Americans could receive a check in the mail as compensation for being overpaid for prescriptions. The cuts and payments come from class-action settlements involving Pfizer and Sanofi Aventis.
Our firm’s San Diego personal injury lawyers believe patients should be charged correct amounts for prescription drugs to help with personal injury. Medical bills can already be expensive without overcharging for prescription drugs.
Two drugs that were widely overcharged are Lipitor, a drug manufactured by the Pfizer Corporation to treat high blood pressure, and Ambien, manufactured by Sanofi Aventis to treat certain brain disorders like insomnia.
Lipitor is a very important drug because high blood pressure can lead to heart attacks that can cause wrongful death. What if a patient who needs Lipitor is driving and can’t afford their medication because of the overpricing? A heart attack can cause a car accident that leads to personal injury like whiplash or a spinal cord injury causing paralysis (i.e. paraplegia & quadriplegia).
The settlement calls for a $60 million pot to be set aside for the purpose of reimbursing consumers who were overcharged between August 2001 and January 23, 2009 causing high medical bills.
Prescription drugs are important for people with personal injury to treat or cure what is wrong. Overcharging for those prescription drugs makes a hard situation even more difficult later on.
This firm’s personal injury lawyers in San Diego know the settlement is a way to correct the errors of being overcharged for prescription drugs leading to higher medical bills. However, we believe this situation should not have happened in the first place.
