Sacramento's Largest Personal Injury Settlement Awarded

An Oregon girl that was accidentally run over by a truck driven by her father was awarded a $24.3 million personal injury settlement following a trial involving a semi-truck accident that happened in 2004.

Diana Yuleidy Loza-Jimenez was given the settlement by a Superior Court jury on March 5, 2010 from Freeway Transport, Inc., the Portland, Oregon trucking company a judge found responsible.  According to the Sacramento bar association, this personal injury settlement is the largest in Sacramento County history.

Our personal injury attorneys in San Diego know that no settlement can replace the perfect health of a child.  Children’s injuries can be extremely detrimental to future growth.  If the accident happens at too early of an age, for example, growth can be slowed or even halted.  The settlement does help take care of the medical bills that are a result of the multiple surgeries the truck accident caused.  Loza-Jimenez suffered catastrophic injuries to her entire lower body that will likely require an several future surgeries.

Six years ago, Loza-Jimenez, who is now 14, joined her family on a Thanksgiving long-haul trip from their house in Hermiston, Oregon to Bakersfield, California where they were going to visit relatives and pick up a load to bring back to Oregon.  While traveling, they stopped near Mount Shasta, and the driver of the truck, Simon Loza Mejia, got back in the truck and pulled out with his daughter still outside.  Loza-Jimenez was pulled underneath the truck’s rear wheels, which caused her injuries.

The Freeway Transport defense team argued that because wasn’t the actual long-haul carrier, they shouldn’t be held responsible.  The company brokered Loza Mejia’s truck deal to haul the shipment.

Our San Diego personal injury attorneys believe the settlement will definitely help Loza-Jimenez in the future, but there’s no amount of money that can substitute for a high quality of life.  Depending on the extent of the damage, Loza-Jimenez may never be able to return to a great quality of life, and the settlement can’t replace what she may miss out on with her peers.
