Two injured persons are claiming that the U.S. Department of Veteran Affairs hospitals are responsible for medical malpractice that lead to their contraction of hepatitis and the human immunodeficiency virus (HIV).
Our firm’s San Diego personal injury lawyers believe that hospitals and physicians should do everything in their power to prevent personal injury that comes from infectious diseases. Typically, you go to a hospital to get cured, not get sick.
Since February, 2009, HIV tests have come back positive for five injured persons and 33 others tested positive for hepatitis, all of whom were treated at VA hospitals. Currently, Veteran Affairs has notified more than 11,000 injured persons treated at three medical centers around the country to get follow-up blood checks since they may have been exposed to infectious body fluids.
Veteran Affairs hospitals in Florida, Tennessee, and Georgia are being accused of medical malpractice that led to injured persons contracting hepatitis and HIV, claiming they were infected by the hospitals’ dirty medical equipment.
The American Society for Gastrointestinal Endoscopy released a statement claiming that injured persons who recently tested positive for HIV and hepatitis may have had either of these viruses for years before being treated at VA clinics but they simply did not display the symptoms.
But do you not think that all medical facilities should be testing for these diseases in injured persons and that their negligence to see the infections earlier could still qualify as medical malpractice?
Our San Diego personal injury lawyers believe that because hospital negligence can have dramatic after effects, hospital personnel needs to be extremely careful in treating and caring for patients. The smallest mistake could lead to injuries or wrongful deaths.
If doctors do not catch diseases in injured persons when they are treating personal injuries, then who will?
