Design Defect In Heart Device Linked To 13 Wrongful Deaths

A heart device manufacturer reported the wrongful deaths of 13 people as a result of a design defect in a heart device on April 10, a device that was originally taken off the market two years ago.

Medtronic, a medical technology corporation, cited five deaths when it recalled the product.  The device in question connects a thin electrical cable, known as the Sprint Fidelis, to a device that gives a lifesaving shock to an erratically beating heart, or worse, deliver a shock for no reason.

A previous report from the Food and Drug Administration, the agency that regulates foods, medical treatments and medical devices, indicated that Medtronic began getting reports about the malfunction in five years ago.  Another report showed the company receiving 30 complaints about the design defect and even identified ways the device might be failing.

About 150,000 people in the United States have the Sprint Fidelis lead in their body, and the F.D.A. has gotten nearly 2,200 reports of serious injury related to the leads along with the number of wrongful deaths.

In the following letter regarding the wrongful death design defect dated March 13, 2009, Vice President of Quality and Regulatory Timothy Samsel wrote, “The chance that there will be a problem with your Sprint Fidelis lead remains small.”
