There is no worse tragedy than losing someone you love to a wrongful death. A wrongful death is all the more heartbreaking because it could have been avoided in the first place if proper measures were taken to ensure the safety of all.
That was the case for the families of two Boston firefighters whose wrongful deaths occurred in a Boston restaurant fire, while a third firefighter received burn injuries. The families will split $2.2 million to settle lawsuits they brought against the restaurant, its landlord, and a grease-cleaning company who were held liable for the personal injuries that occurred.
As wrongful death attorneys, we believe that the wrongful deaths of the two firefighters could have been avoided and the restaurant could very well be held liable for not only the wrongful deaths but the pain and suffering of the families they left behind. The third firefighter was also left with burn injuries, which could have caused tremendous pain and suffering and required extensive medical treatment.
After a thorough investigation into the cause of the fire, the Fire Department found explosive conditions in the restaurant’s kitchen, with grease built up to dangerous levels. Restaurant employees had placed a container on the stove to catch drippings from the exhaust hood overhead.
State fire codes require that restaurants have their exhaust ducts cleaned quarterly and cleared of grease buildup. If the restaurant had taken proper measures to ensure the safety of its establishment two lives would have been saved. No wrongful deaths would have occurred and no one would be mourning the loss of their loved ones.
As a result of the wrongful deaths and personal injuries of the firefighters, both the city of Boston and the state enacted tough regulations for commercial kitchen grease cleaners.
