St. Croix County Jail will pay $1 million to the family who filed a wrongful death lawsuit when one of their members died while imprisoned in the county facility.
Our firm’s wrongful death lawyers believe that there is nothing quite as hard as losing a loved one to a wrongful death accident and most of the time we see this happening in fatal car accidents. No amount of money can ever ease the pain and suffering and emotional trauma that comes when family and friends lose someone close to them.
Brandon Hessler was put in jail after breaking into his mother’s house, where he attempted to steal prescription medicine. While at prison, guards found Hessler unresponsive in his cell on March 18, 2007 and transported him to Hudson hospital, where he later died, resulting in a wrongful death lawsuit.
In the wrongful death settlement documents, it was found that the prison guards had acted with “willful indifference” to this prison inmate. Obviously, prison guards cannot stop all violence, but to know about something and to just look the other way is altogether different.
Following Hessler’s wrongful death, four of the jail’s staff members were suspended from duty, including one staff member who was later terminated.
Many times, people experience wrongful deaths in fatal car accidents where there is little-to-no control over the amount of personal injury or property damage that occurs. This is different, however, in that the St. Croix County Jail acted with “willful indifference” in their responsibilities were held liable for the prisoner’s wrongful death.
Our wrongful death attorneys usually see cases where negligence (such as failure to act properly such as the safe operation of a car to prevent car accidents) is the main cause of a serious personal injury or a tragic wrongful death.
Families and friends experience a lot of emotional trauma after a wrongful death of a loved one and while no settlement can fill the void, the persons responsible can still be held accountable in a court of law.
