Nursing Homes Fined For Wrongful Deaths Of Patients

California officials have fined two nursing homes in Orange County for providing insufficient care which caused the wrongful deaths of two patients.

As wrongful death attorneys, we are discouraged by this news because many elderly Americans choose to live in nursing homes so they get proper care, prevent personal injury and limit wrongful deaths.

Imagine if your parents, grandparents or other elderly relatives’ death was caused by inadequate care by nursing home personnel.  Would you not want the nursing home held responsible for the wrongful death of your relative?

At Alamitos West Health Care Center in Los Alamitos, California, staff at the nursing home failed to give sufficient liquids to an 82-year-old woman causing her wrongful death from dehydration and acute kidney failure.

On March 2, 2009, a registered nurse at Huntingdon Valley Healthcare Center did not call 911 as a patient was dying because she thought the patient had orders not to be revived.  The wrongful death should not have happened because a family member marked “I do want C.P.R.” in an emergency.

Americans move into nursing homes when they get older as a way to ensure that proper care is given when they cannot take care of themselves.  If we cannot be confident personal injury or wrongful death can be prevented, the use of these homes can be second guessed.

As wrongful death lawyers, we do believe the need for nursing homes is necessary because some elderly Americans cannot take care of themselves.  Personal injury or wrongful death should be prevented by the nursing staff, and if either of those happens, liability should be assigned.
