The DeKalb County Schools in Atlanta Georgia are facing a wrongful death lawsuit from the family of a fifth-grader who hung himself after he was the target of constant bullying at the district’s Stone Mountain school.
Being wrongful death lawyers, we believe that professionals who are put in charge of the supervision and safety of our children should make sure that they do not experience a personal injury. Wrongful deaths can be prevented if early action is taken by an adult to stop the harassment of one child by another student.
In this case, school administrators did nothing to stop the patent bullying of 11-year-old Jaheem Herrera, which led to the boy’s suicide.
This is case is similar to ones where product liability and defective products are found to be causing personal injury that requires medical treatment and wrongful death. Manufacturers should have their consumers’ health and safety as a top priority, just as the Stone Mountain school should have their students’ well-being at the forefront of their daily concerns.
The school’s negligence in putting an end to the bullying Jaheem was experiencing ultimately caused the wrongful death of the child by his own hands. The planned lawsuit seeks an unspecified amount of damages to help fund the Jaheem Herrera Foundation, which has been formed to stop bullying in schools.
As wrongful death lawyers, we believe teachers, administrators, and other school official which have the responsibility of maintaining the well-being of our children. We hope that no little girl or little boy should experience a wrongful death due to a teacher’s neglect at putting a stop to fellow student harassment which the school staff either knew about or should have know about.
