Wrongful Death From Dentist's Mistake Leads To Medical Malpractice Lawsuit

A Florida dentist is being sued by the family of a 90-year-old man whose wrongful death was caused by the dentist who accidentally dropped tools into his body while he was working on his mouth.

Relatives of Charles K. Gaal Jr. recently filed a lawsuit in Orange County Circuit Court against Dr. Wesley Meyers of Aloma Park Dental.  They say Meyers did not take measures to prevent against dropping his tools down Gaal’s throat.

A lawsuit claims a dentist dropped tools into an elderly mans body causing his wrongful death.

As wrongful death attorneys, we know that sometimes mistakes can happen, but a trained medical professional should not cause an injury or wrongful death.  Dentists, or anyone else who works on a person’s body, should be extra careful to make sure they do not make a mistake that can cause someone their life.

Doctors and dentists use sharp instruments when they are working on their patients.  If these tools are not handled properly, personal injury is likely and wrongful death can be possible.

In May 2007, Meyers was removing a “ball” attachment on an implant, and during the procedure, Meyers dropped a “mini-wrench” into Gaal’s throat that he also swallowed.  Gaal had his chest cavity cracked open to remove the tool, but never recovered.  He died during a cardiac event a month later.

But that was not the first time that Meyers had dropped an instrument into Gaal’s mouth.  Seven months earlier in October 2006, Meyers dropped an “implant screwdriver tool” down Gaal’s throat.  Gaal swallowed it and had a colonoscopy to remove it two days later.

As wrongful death lawyers, we believe that if someone else needs to be held responsible for a wrongful death, hiring an experienced attorney can help with getting a settlement based on your loss, but also can help you pay medical bills in the event of serious injury.  When a licensed professional like Dr. Meyers continually makes the kind of mistakes that those in his position should not, he should be held liable.
