The family of a toddler, who died after getting himself tangled in a soccer net, has filed a wrongful death lawsuit against a Dallas suburb and the responding police officers after their negligence led to his wrongful death.
As wrongful death attorneys, we understand that personal injuries take many forms, but wrongful death can often be the result. The worst kind of mistakes — the kind of actions that deviate away from standard procedures — sometimes cause the wrongful death of an individual, but it is especially hard when children’s injuries become wrongful deaths.
This wrongful death lawsuit (the wrongful death of a Kentucky toddler) was filed Tuesday in federal court, claiming that emergency responders refused to give CPR instructions on the phone to the mother of 21-month-old Matthew Cantrell in 2007, causing his wrongful death.
The lawsuit also claims that Murphy police officers thought the boy was dead and treated the home like a crime scene by barricading the mother and another son in a bedroom before medical technicians arrived. Their negligence, in mistakenly deeming the boy to be dead, furthermore led to his incidental wrongful death as the police initially refused those technicians access to the boy in an attempt to administer medical treatment.
“When you call 911, you think they’re going to help,” said Michael Cantrell, the boy’s father. “But here, no one tried to help — not the 911 operator, not the Murphy police officers who were first on the scene. Not one of them tried to save my boy’s life.”
As wrongful death attorneys, we understand that accidents can happen. But if those accidents are caused by negligence and lead to a wrongful death someone should be held accountable.
