A district court in Utah awarded a wrongful death settlement of over $4 million to the widow and children of a man who was in a fatal car accident in 2006.
Richard Kunzler’s family claimed in a lawsuit that the state Department of Transportation and subcontractors working on a bridge near Spanish Fork, Utah (south of Salt Lake City) failed to post appropriate signs warning motorists about traffic delays, which led to the fatal automobile accident.
Our wrongful death lawyers know there are many causes to fatal auto accidents. Sometimes, these reasons are out of the driver’s hands. Construction zones and potholes can cause car crashes because they are very hazardous, with materials potentially flying out from any direction or reduced speeds on highways.
Because of those dangers, it is important for the proper warnings to be placed to prevent a car accident that could cause injuries like whiplash, traumatic brain injuries or wrongful deaths caused by fatal automobile accidents.
According to the wrongful death lawsuit, Kunzler knew about the construction project, but because appropriate signs weren’t posted, Kunzler didn’t know there was a traffic backup in Benjamin, Utah — west of Spanish Fork.
Kunzler’s attorney said Kunzler came over the crest of a hill on July 18, 2006 when the driver in front of him saw stopped cars and slammed on his brakes. Kunzler tried to swerve to miss but crashed. He died about two weeks later.
Placing necessary signs and warning to prevent car accidents near construction zones saves lives. Cars are traveling at slower speeds, and traffic tends to increase in these areas. Taking steps to increase safety before automobile accidents happen can only be beneficial to all drivers as well as workers at the site.
Our car accident lawyers believe taking steps to save the lives of drivers should be a high priority for companies or employees of state Departments of Transportation. Millions of people travel on streets and highways every day, so making sure they are as safe as possible is critical.
Just to be on the safe side, make sure you find the car insurance policy that is best for you, in case you or anyone else is injured out on the roads.
