And we thought the only thing scary at the pump these days was the cost per gallon.

A typical trip to the Chevron turned very dangerous when the driver of a car caused an auto accident that pinned one man against a building, but not before hitting another man and causing his personal injury.  This happened when she got confused about which pedal her foot was pressing up against.

Our firm’s auto accident attorneys are glad that no one was severely hurt and no wrongful deaths occurred as a result of this unfortunate situation.  Many times we deal with cases that involve everything from whiplash to major traumatic brain injuries — all of which could have potentially happened at this accident.

On Sunday, November 14th, 2009, the driver in question was filling up her tank at a Carmel Mountain Road Chevron in Rancho Penasquitos.  When she was done, she got in her car with the intent hit the brake.  Instead, she hit the gas and the car went out of conrol, running over a biker (causing a motorcycle accident) before plowing straight into a man putting air in his tires.

According to eyewitnesses, the man shouted for the driver to stop before he became pinned between the car and the wall of a nearby building for a while emergency crews rushed to the scene to treat his minor injuries.  The other injured person was taken to the hospital where it was revealed that several bones were crushed.

The San Diego Police Department has no reason to believe that the driver was under driving under the influence (DUI) of alcohol or drugs, and that she was very sorry for all of the chaos she was responsible for.  Our auto accident attorneys hope that we can all learn from this lesson: make sure that you always drive safe and you know where your feet are in relationship to the pedals on your car.
