When children are too young to know the rules of the road and how to cross it safely, that’s when serious accidents occur.  Our firm’s Spring Valley car accident lawyers are always saddened to hear the news of a child’s wrongful death and this case is no exception.

According to San Diego 6 News, a pick-up truck fatally hit a young Spring Valley girl after she had just bought ice cream from a truck vendor in a local Southeast neighborhood.  The pedestrian accident happened around 3 p.m. on a Friday afternoon when the little girl was playing at a friend’s house and they went to purchase a snack.

San Diego Police officials have determined that the 35-year-old driver of a pick-up truck will not be charged or cited for causing her fatal children’s injuries.  Police say that the young child was at a fault because after purchasing her ice cream, she darted out behind a parked car and into the path of the man’s truck.

After striking the girl with his vehicle, the man stopped and paramedics came to the scene where they rushed the girl to Rady Children’s Hospital for further medical treatment, but she passed away shortly after.  She was 7-years-old.
