A man and his 8-year-old son crossed an intersection, hand in hand, every day before school.  But one morning, their routine walk turned tragic when out of nowhere, a speeding car ran a red light and smashed into the two in a horrific pedestrian accident.

The hit-and-run car driver struck the pair about 8 a.m. in the crosswalk on January 26, 2009, at Story Road and Adrian Way, where the father-son pair had a green light and right of way to walk.

The pedestrian accident lawyers at our firm believe in safe driving and urge everyone to drive carefully, especially around school zones.  They want to remind everyone that speeding causes car accidents, so please follow the posted speed limits and abide by all traffic signs and lights.

At first, the man thought his son was dead after the car accident, but a passing driver who stopped at the accident happened to be a nurse and discovered a pulse.  Thankfully, the young boy opened his eyes for a moment before paramedics took him away, dismissing any doubts that he had succumbed to a wrongful death.

The young boy was admitted, in critical condition, to the Santa Clara Valley Medical Center for medical treatment on his brain injury and several broken bones he sustained in the accident.  The young boy also suffered brain damage from the pedestrian accident, but returned home from the hospital after a quick recovery.

California car accident attorneys can file a claim for “negligent infliction of emotional distress” if someone sees a loved one injured, in addition to any other pedestrian accident claim.

A 19-year-old grocer — a man without a valid driver’s license — was arrested four days after the pedestrian accident on suspicion of felony of hit and run.  Police say his car ran a red light before the pedestrian accident with the father-son pair.

What happened is terribly saddening to hear, and our firm’s hope is that future drivers and pedestrians can learn to be more careful on the road, whether you are driving or walking on it.
