The Food and Drug Administration (FDA) held a meeting on April 22, 2009 to determine whether the organization’s device center was illegally approving defective products that could cause harm to people in auto accidents.

Medical device makers have already been asked by the FDA to justify the safety in some of their products currently on the market, including external heart defibrillators, dialysis catheters, hip joints, spinal screws, heart pumps and equipment that assists with injured persons with breast cancer and orthopedic knees.

Our firm’s San Diego personal injury lawyers are concerned about what this means for people who experience personal injuries in automobile accidents due to products liability issues.

Many of these medical devices are potential design defects that could cause more pain and suffering for an injured person instead of helping in the recovery process.

A large number of these devices, many that are implanted in injured persons, have never been tested for effectiveness or safety.  Approval for the marketing of these potentially defective products came after an exchange of only a handful of correspondence between the FDA and a manufacturer.

What if one of these design defects had been used to treat a personal injury you have?

Suppose you are in a car accident where you experience a personal injury.  You are told by physicians that you need spinal screws embedded into your spinal cord or vertebrae.  The problem is that these screws turn out to be defective products that actually add to the amount of pain and suffering you are in, as well as keep your original spinal cord injury from healing.

Our firm’s personal injury lawyers in San Diego have handled cases where a personal injury from an automobile accident grows more painful and severe due to a defective product that used during the injured person’s medical treatment.

We believe that everyone should be able to have medical devices, that are not defective products, readily available for our use if we find ourselves in an auto accident.  After all, how is a defective product going to improve our health in any way?
