A nine-year-old girl was killed and the driver of the car she was riding in was arrested on suspicion of drunken driving after a multi-car crash in North San Diego County on I-5 Monday morning.
In our experience, as car accident attorneys in San Diego, it seems often times the drunk driver is the one that survives a drunk-driving car accident, and innocent people are the ones that are killed. The young girl was riding in the right backseat of a 2006 Lexus RX 330 at about 1 a.m. when the driver, a man, 23, failed to notice that vehicles in front of him were slowing down. The man swerved to the right and had a car accident with a Dodge Caliber before losing control of the SUV. The out of control car then had an auto accident with a Honda CRV, before a rear end collision with a semi truck.
The young girl was taken by helicopter to Rady Children’s Hospital where she her wrongful death was confirmed.
The suspected drunk driver suffered minor injuries and was arrested on suspicion of DUI.
The driver of the Dodge suffered minor injuries and the driver of the Honda was taken to a hospital with moderate injuries. The semi truck driver was not injured.
In 2004, of all wrongful deaths of the children ages 14 and younger, 21 percent of them were due to DUI car accidents.
