Texas lawmakers are considering a proposed law that would restrict state medical regulators from investigating and disciplining doctors accused of medical malpractice.
As San Diego personal injury lawyers, we are concerned what a piece of legislation could mean for the unfortunate patients of doctors and physicians who are legitimately guilty of medical malpractice. Can you imagine being the injured person involved in a medical negligence case and not being properly compensated for your pain and suffering?
Supporters of the law say the legislation is necessary to put a stop to abuses of the Texas Medical Board allegedly committing. Fingers are being pointed at the board for abuse of power, saying that the board is going after minor infractions to injured persons, which is costing doctors thousands of dollars.
Worries were voiced by supports of the bill about wrongful medical malpractice suits being filed against practitioners of alternative medicine and those who treat conditions such as autism. The bill would provide a higher level of fairness to doctors who, according to some, are the target of persecution by the Texas Medical Board.
“The board should not be telling people how to practice medicine,” said Andy Schlafly, the son of famous conservative activist Phyllis Schlafly and counsel leader for the Association of American Physicians and Surgeons, who helped co-write the bill.
Those against the legislation claim that it would leave injured persons extremely vulnerable to medical malpractice and would make it difficult for patients to complain about negligent doctors.
After all, this is Texas, a state where the Legislature has made it almost impossible for an injured person to sue over medical malpractice.
