Sherwin Williams Inc., an American based paint manufacturer, has been found liable for the personal injuries of a Mississippi boy who ate lead-contaminated paint chips.
Trellvion Gaines ingested lead-contaminated paint chips while staying at his grandmother’s house, a residence she has lived at since the 1970′s.
The lead found in some older Sherwin Williams paint caused brain damage and children's injuries.
Our firm’s personal injury lawyers in San Diego believe that if a design defect in a product causes a loved one or you personal injury or pain and suffering the manufacturer of that product should be held liable. The worst part is that if proper precautions had been taken in order to ensure the safety of a product no physical disabilities would have resulted in Trellvion.
Lead based paint was banned in the United States in 1978 after it was found to cause severe children’s injuries such as nervous system damage, hearing loss, stunted growth, and delayed development. Furthermore the paint has been found to cause problems in reproduction for men and women.
The products liability lawsuit claims that Gaines was exposed to lead dust and chips from sanding, scraping and other steps recommended by Sherwin Williams to remove the lead paint from the house before paint that’s not lead based could be applied.
“The brain damage became evident in the first grade, consistent with the CDC statements that lead-induced brain damage may take years to manifest in the harmed children,” the family’s attorney said.
Today Gaines, now a teen, still reads only at a second- or third-grade level and shows other signs of cognitive delays as a result of the defective product. Our heart goes out to Trellvion Gaines and his family.
Our personal injury lawyers in San Diego know that this tragedy could have been avoided if Sherwin Williams had properly instructed and informed individuals of the defective products that caused personal injury.
