A Darlington County jury returned a verdict of $9 million after finding Progress Energy responsible for the wrongful death of 21-year-old Allen Toney of Hartsville.
Our wrongful death attorneys understand that these types of accidents cause extreme pain and suffering as well as permanent scarring. In addition to the bodily personal injury these accidents have on individuals they also cause emotional trauma to the family members who lose someone they love due to the negligence of a company or individual.
Toney suffered numerous personal injuries after being electrocuted by a fallen power line. Toney touched the power line after a storm caused a utility pole, maintained by Progress Energy, to fall into his driveway. While trying to move it from his driveway, Toney was electrocuted and sustained numerous burn injuries — which he later died from.
Progress Energy was negligent in responding to numerous inspection notifications of the hazardous condition of the utility pole in the months prior to the incident. They also presented evidence that Progress Energy was negligent in responding to numerous phone calls made to the Progress Energy Call Center prior to the wrongful death.
Those calls provided notification and warning to Progress Energy about the downed power line and the dangerous conditions related to it. Based on the verdict, the jury found that Progress Energy was negligent and that caused the Toney’s wrongful death.
