Wisconsin Medical Malpractice Lawsuit Revived

Posted in Personal Injury, Tuesday, July 7th, 2009

A Wisconsin court has revived an elderly woman’s lawsuit accusing a St. Croix Falls surgeon of medical malpractice and negligence in her hip surgery.

As a society, we put a lot of trust into trained health-care professionals to cure us when we are unhealthy.  We put our faith in doctors when something is not right with our bodies.

Our firm’s San Diego personal injury attorneys believe that if a licensed health-care physician is negligent in caring for a personal injury, this can cause medical malpractice leading to more significant personal injuries forcing you into debt because you’ll need assistance in paying your medical bills.

Medica malpractice has been linked to thousands of personal injury claims every year.

Medical malpractice is medical negligence or carelessness by a health care provider in which care provided is not from accepted standards of medical practice — causing injury or wrongful death to a patient.   According to a study by Health Grades, Inc., over 195,000 people die each year due to medical malpractice.  Medical negligence and related medical errors are the sixth leading cause of wrongful death in the United States.

Luckily for 65-year old Marlene Petzel the negligence by her doctor did not lead to a wrongful death but it did cause her more significant personal injury and pain and suffering.  The 3rd District Court of Appeals ruled that a Polk County judge was wrong in dismissing Mrs. Petzel’s lawsuit against Dr. Mark Wikenheiser and Valley Orthopedics of St. Croix Falls.

The three-judge panel says there’s a factual dispute in the case and a jury should sort out the evidence.

Court records say that Petzel had hip replacement surgery in 2003, but she claims a nerve in her knee was wrongly damaged and it caused partial paralysis of her foot.  Court records say experts in the suit disagreed whether the injury occurred at the knee due to positioning or trauma, or at the hip which was the site of the surgery.

Our personal injury attorneys in San Diego believe that justice should be served for medical malpractice that leads to personal injury or even a wrongful death.
