The American Civil Liberties Union (ACLU) demands that the city of Escondido change the way it conducts driver’s license checkpoints, a potential hazard for catching unprepared drivers off guard by the roadblock and find their cars involved in an auto accident.
Our car accident lawyers know that officers of the law put themselves on the front line everyday to protect our safety. However, we have concerns that these checkpoints could surprise motorists who are unaware of their presence, causing a car accident, pedestrian accident or even a wrongful death accident.
Right now, Escondido has checkpoints about twice a month, for two hours at a time, on roads with high amounts of traffic.
Critics of the checkpoints say that they are intended to apprehend and deport illegal immigrants, with resentment and suspicion aimed at many Latinos. Others say that negligent drivers will find alternative roads to avoid being stopped. These routes may include local residential areas where the chances increase for being involved in a pedestrian accident.
All these are valid worries, but perhaps the most likely hazard would be simply catching motorists by surprise and not in a good way.
Suppose you are driving down a road that you have gone down many times before. There is little traffic and very few intersections, so you know that for the most part there will be very few changes in your normal route. As you come around a bend, a checkpoint comes out of the blue. You attempt to break so as not to cause a car accident with the police vehicle, but it is too late.
Instead of missing the car, you run straight into its side, causing property damage to the automobile while the police officer seated inside suffers a severe personal injury.
Being auto accident lawyers, we work cases every day where car drivers end up in auto accidents that result in personal injury, property damage, pain and suffering, and fatal car accidents. We urge everyone to obey the law and drive carefully as you are one the lookout for potential checkpoints in your commute.
