An investigation by the Food and Drug Administration (FDA) and the California Department of Public Health (CDPH) continues to look into an outbreak of Salmonella that contaminated a large shipment of pistachios and pistachio products that may have caused personal injury.

Setton Pistachio of Terra Bella, Inc., a California based company, is recalling all shipments of roasted in-shell pistachios, as well as roasted shelled pistachios that were produced from nuts harvested in 2008 and some pistachios from the 2007 crop that are considered to be a product liability.

Raw shelled pistachios, one that are not subsequently roasted prior to retail sale, from the 2008 crop (and some from the 2007 crop that were also processed on the same equipment as the 2008 crop), are also being recalled to avoid personal injury in consumers.

On March 30, 2009, Setton’s original recall was limited to certain lots of roasted pistachios, but after FDA and CDPH inspections indicated the presence of Salmonella in critical areas of the firm’s facility and the potential for cross-contamination between raw and roasted products.  In order to prevent any personal injury from occurring, the firm decided to expand its recall on April 6, 2009.

There have been no reports of personal injury or illness caused by Salmonella-tainted pistachios produced by Setton Pistachio.  The Obama administration reports that it has a tight leash on the FDA, especially in this case, to prevent personal injury and wrongful death due to contaminated foods.  The FDA’s initial request of a limited recall marked the first time the agency has requested a recall prior to illnesses being reported.
