There is renewed government focus on shaking up the Food and Drug Administration (FDA) who, according to recent reports, has been turning a blind eye in cases of pharmaceutical and other medical devices products liability.
Our firm’s personal injury attorneys in San Diego think it is shameful that a branch of the government has been able to get away with lax enforcement of rules and regulations concerning products liability. An injured person who is subjected to product liability can potentially increase the pain and suffering that they are already in, leading to emotional trauma for the rest of their lives.
The latest reports that have been released concerning the FDA’s oversight with product liability are shocking, to say the least.
The inspector general for Health and Human Services cited that the FDA does little to investigate the dangers of product liability in clinical trials for pharmaceutical and medical products used to treat injured persons. More importantly, it hardly does any research at all to determine whether the doctors conducting such trials could have a financial conflict with a pharmaceutical company.
Legislation from 1999 requires companies to release such data, but it is very rarely ever collected by the FDA. Defective products could be marketed to the general populous without anyone from the FDA making sure the products are actually safe.
Basically the FDA has gotten lazy and does not even want to enforce its own rules regarding product liability for products used in medical treatment of injured persons.
Our firm’s personal injury attorneys in San Diego are aware of how valuable information regarding products liability can be when it comes to injured persons determining a course of treatment for their personal injuries. Without the proper research being done on product liability by the Food and Drug Administration, injured persons might experience more pain and suffering, rather than getting the help they need.
If we cannot trust the FDA to watch out for medicines and drugs with stringent testing, then who can we trust? Another way to think of this is if the “fox is guarding the henhouse,” and moreover, who is the “fox”?
