Many of us know about ATVs (“All Terrain Vehicles”) and how dangerous they are.  However, we believe very few have heard about about a UTV (“Utility Terrain Vehicle”), which is a hybrid between a golf cart and an ATV.  These off road vehicles accidents are extremely dangerous, just like car accidents on the road.

Typically, when a new product is introduced into the market it is governed by general safety standards.  However, the UTV, unlike an ATV or a car, has no safety standards because it is a new vehicle which was created before a law could be created to regulate it.

A legal representative for Yamaha Motor Corporation, USA, stated in part:

“If you operate it carefully and use some common sense and good judgment, it’s a really great product.”

In fact, the company even went on to state that many of the personal injury complaints are due to operator error, such as getting distracted while driving.  What makes this whole matter even more confusing is Yamaha’s other statement:

“Yamaha cares about every customer and we are deeply saddened whenever anyone is injured in a Yamaha product related accident.”

The Yamaha Rhino sold about 10,000 vehicles in the United States in 2004, 20,000 in 2005 and 40,000 in 2006 and 2007.

As auto accident attorneys, we are very concerned about products that are released into the open market without any regulations.  UTV accidents are responsible for serious personal injuries including physical disabilities, and even death.  Also, many of the best car insurance policies may not cover a UTV or ATV accident which were not on public roadways.
