Santa Claus is coming to town.  Even if you were nice this year, you could find your stocking stuffed with products liability gifts that could hurt you or your children.

For 2009, the Consumer Product Safety Commission (CPSC) has recalled at least 38 children’s toys due to product liability, a significant drop from 2007 when 45 million toys were recalled, because of a rise public awareness and safety requirments.

The 24th anuual Trouble in Toyland survey by the Public Interest Research Group (US PIRG) researched the inventory of toy stores and dollar stores for dangerous products, discovering 16 toys that either had potential hazards associated with them (regardless if they met standards) or violated current guildlines set up by state and federal laws.

Still, everyone is warned that there continues to be toys on shelves that can personally injure children, be wary about what you purchase this holiday season.

“We are seeing progress, but there’s no magic wand you can wave to improve the CPSC overnight,” says a public-health advocate with US PIRG, who helped the organization conduct a new report since toy safety regulations were strengthened by the United States Congress.

The CPSC focused on four hazards.

  1. Children under the age of three choking on tiny, detachable parts of toys.
  2. Hearing damage caused by loud noise or music.
  3. Objects with lead-based paint covering them.
  4. A chemical called “phthalates”, which is found is soft, plastic toys.

According to the CPSC’s recording, in 2008, 19 children experienced wrongful deaths due to toy-related injuries.  During that same time period, more than 82,000 children under the age of five made visits to emergency rooms for medical treatment after being hurt by certain hazardous products.
